dc.descriptionThe purpose of this paper is to analyze the sovereign immunities –from jurisdiction and execution– possess by States and their entities in view of litigation, arbitration and execution of foreign judgments or arbitration awards. It will determine what are the normative and jurisprudential criteria, local and international, under which these immunities have been applied, aimed to answer the following questions: (i) when is it possible to sue a State before a court outside its domain; (ii) what assets of one State can be executed in other States; (iii) what differences exist when in the two previous situations the defendant is not the State, but a State entity or company. Regarding this last point, it will analyze what happens when it is intended to execute assets of these entities through awards or judgments issued against the State to which they belong.
dc.descriptionEl objeto del presente trabajo es analizar las inmunidades soberanas –de jurisdicción y de ejecución– que gozan los Estados y sus entidades ante litigios, arbitrajes y ejecución de sentencias extranjeras o laudos arbitrales. Se determinarán cuáles son los criterios normativos y jurisprudenciales, locales e internacionales, bajos los cuales estas inmunidades han sido aplicadas, pretendiendo responder las siguientes interrogantes: (i) cuándo es posible demandar a un Estado ante un tribunal fuera de su dominio; (ii) qué bienes de un Estado son pasibles de ejecución en otros Estados; (iii) qué diferencias existen cuando en las dos situaciones anteriores no es el Estado el sujeto demandado, sino una entidad o empresa estatal. Sobre este último punto también se analizará qué sucede cuando se pretende ejecutar bienes de estas entidades por laudos o sentencias dictadas en contra del Estado al que pertenecen.
