| dc.description | This article seeks to renew the understanding of civil mens rea through hermeneutics. It poses the need and usefulness of the application of the circumstantial evidence, as well as its evidentiary standard, to the civil mens rea. In short, this work does not intend to make an objective turn in the understanding of mens rea. Instead, it proposes a model that facilitates the proof of this element without modifying its subjective character. | |

En particular, se plantea la necesidad y utilidad de la aplicación de la prueba indiciaria, así como su estándar probatorio, al caso dolo civil. En definitiva, este trabajo no tiene por finalidad hacer un giro objetivo en la comprensión del dolo, sino que proponer un modelo que facilite la prueba sin modificar su carácter subjetivo. | |
